1. Overview
This website is operated under the trading name Averyton by RAVIS MIMARLIK MUHENDISLIK INSAAT SANAYI VE TICARET LIMITED SIRKETI.
Throughout these Terms of Service, the terms “Averyton,” “we,” “us,” and “our” refer to the legal entity operating www.averyton.com.
Averyton provides this website, including its information, content, features, products, customer services, and purchasing facilities, subject to these Terms of Service and all other policies referenced in them.
By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms of Service.
If you do not agree with these Terms, you should not use the website or place an order.
Nothing in these Terms excludes, restricts, or replaces any mandatory consumer rights available under the laws of the country in which you reside.
2. Eligibility
You must be at least 18 years old or have reached the legal age of majority in your jurisdiction to place an order.
By placing an order, you confirm that:
You have the legal capacity to enter into a binding contract.
The information you provide is accurate, complete, and current.
You are authorized to use the payment method selected at checkout.
You are purchasing products for a lawful purpose.
You will not use the website or products in violation of applicable law.
If you are placing an order on behalf of a company or another legal entity, you confirm that you have authority to bind that entity.
3. Shopify Platform
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to display and sell our products.
Your use of certain website features may also be subject to Shopify’s applicable terms and privacy practices.
Shopify is our ecommerce technology provider and is not the seller of Averyton products. Your contract for the purchase of products is with the legal entity operating Averyton.
4. Products
Averyton offers art prints, posters, framed prints, framed posters, canvas products, framed canvas products, and selected home decor products.
Many Averyton products are made, printed, assembled, or framed after an order is placed.
Product availability, formats, sizes, paper options, frames, materials, finishes, and production methods may vary.
We make reasonable efforts to describe and display our products accurately. However, the appearance of colours may vary depending on screen calibration, device settings, ambient lighting, printing process, ink absorption, paper texture, canvas texture, and natural material characteristics.
Minor variations that are normal for fine art printing or natural materials do not necessarily constitute a defect. Significant errors, physical damage, incorrect materials, or products that materially differ from the description will be handled in accordance with our Return and Refund Policy and applicable consumer law.
5. Historical Artworks and Restorations
Averyton offers reproductions of historical artworks, including works that may be in the public domain.
Where an underlying artwork is in the public domain, Averyton does not claim exclusive ownership of or copyright in the original historical artwork itself.
However, to the extent permitted by applicable law, Averyton may own or control rights relating to its own:
Digital restoration work
Colour correction and image preparation
Print ready files
Cropping, formatting, and presentation choices
Product photography and mockups
Website text and editorial descriptions
Branding, logos, graphics, and website design
The purchase of a physical Averyton product does not transfer ownership of Averyton’s digital production files, product photography, branding, website content, or other protected materials.
Unless expressly stated otherwise, Averyton is not affiliated with, sponsored by, or officially endorsed by any museum, gallery, historical institution, artist estate, government organization, or other rights holder mentioned in a product description.
References to artists, museums, historical events, artistic movements, and cultural institutions are provided for identification, education, and historical context.
6. Product Information
We make reasonable efforts to ensure that product descriptions, dimensions, prices, photographs, materials, and availability information are accurate.
Dimensions may be rounded, and minor production tolerances may occur.
Frames, canvas depths, borders, crops, and proportions may appear slightly different depending on the selected format and size. Product pages should be reviewed carefully before an order is placed.
If we discover a material error in a product description, price, or availability before dispatch, we will contact you and provide a reasonable opportunity to:
Confirm the order with the corrected information
Select an appropriate alternative where available
Cancel the affected product for a full refund
We will not substitute a materially different product without your consent.
7. Orders and Contract Formation
Placing an order constitutes an offer to purchase the selected products.
After an order is submitted, you may receive an automatic confirmation acknowledging that we have received the order. This acknowledgment does not necessarily mean that the order has been accepted.
Unless applicable law or an order specific agreement provides otherwise, an order is accepted when:
We send a dispatch or fulfilment confirmation
Production begins and we confirm acceptance
We otherwise expressly confirm that the order has been accepted
We reserve the right to refuse or cancel an order for legitimate reasons, including:
Payment authorization failure
Suspected fraud or unauthorized payment activity
Material pricing or product information errors
Product or material unavailability
Shipping restrictions
Violation of these Terms
Legal or regulatory restrictions
Inability to complete or deliver the order
If we cancel an order after payment has been collected, we will issue a refund to the original payment method.
We will not cancel an order for an arbitrary or discriminatory reason.
8. Order Information
You are responsible for reviewing the following information before completing checkout:

Paper, canvas, or material selection
Frame selection
Size and orientation
Quantity
Billing and shipping address
Contact details
Selected delivery method
Please contact support@averyton.com immediately if you discover an error.
Because products may enter production shortly after an order is confirmed, changes cannot be guaranteed after production begins.
9. Prices and Currency
Product prices are displayed in the currency selected on the website or determined by the customer’s market.
Prices may change without prior notice. A price change will not affect an order that has already been accepted, except in the case of an obvious and material pricing error handled in accordance with these Terms.
Any applicable taxes collected by Averyton will be displayed or calculated at checkout where required.
Currency conversion may be performed by the payment provider, card issuer, bank, Shopify, or another financial service provider. Exchange rates and foreign transaction fees applied by these parties are outside Averyton’s control.
10. Customs Duties and Import Charges
Orders may be produced or shipped internationally.
Depending on the destination country and fulfilment location, an order may be subject to customs duties, import taxes, brokerage charges, handling fees, or other government charges.
Where these charges are not expressly included at checkout, the customer may be responsible for paying them to the appropriate authority or carrier.
Averyton does not control customs assessments or customs clearance processing.
We will provide accurate order and shipping information as reasonably required, but we cannot guarantee that a shipment will be free from customs inspection, delay, or additional charges.
11. Payment
Payment must be made using a payment method offered at checkout.
Payments may be processed by iyzi Odeme ve Elektronik Para Hizmetleri A.S., operating as iyzico, Shopify, card networks, issuing banks, acquiring banks, or other authorized payment providers.
Payment processing may be subject to additional verification, fraud screening, authorization, and regulatory checks.
Averyton does not intentionally store complete payment card numbers or card security codes on systems directly controlled by Averyton.
An order may be delayed, declined, or cancelled if payment cannot be authorized or if additional verification is reasonably required.
Refunds are issued to the original payment method in accordance with our Return and Refund Policy and applicable law.
12. Production and Fulfilment
Averyton products may be produced and fulfilled by carefully selected third party printing, framing, canvas, packaging, and logistics providers.
These providers may operate from different countries or production locations.
The use of a production or fulfilment provider does not remove Averyton’s obligations to customers under the sales contract or applicable consumer law.
Production times are estimates and may vary depending on:
Product type
Selected size and material
Frame or canvas configuration
Order volume
Quality control requirements
Production location
Seasonal demand
Supply availability
A product will not be considered late solely because production takes longer than an estimate, provided that delivery still occurs within the promised or legally permitted period.
If a material delay occurs, we will provide notice and any cancellation or refund option required by applicable law.
13. Shipping and Delivery
Shipping estimates are provided for guidance and are not guaranteed delivery dates unless expressly stated otherwise.
Delivery times may be affected by production, carrier operations, customs processing, weather, public holidays, remote destinations, security events, or other circumstances beyond reasonable control.
Customers are responsible for providing an accurate and complete delivery address.
If an order cannot be delivered because of inaccurate or incomplete information supplied by the customer, additional production, return, or reshipment charges may apply where permitted by law.
Risk of loss remains with Averyton until the product is delivered to the customer or a person designated by the customer, except where applicable law provides otherwise.

14. Cancellations
Cancellation and modification requests should be sent to support@averyton.com within 2 hours of placing an order.
We will make reasonable efforts to cancel or modify an order before production begins, but we cannot guarantee that changes will be possible after an order enters production.
This operational cancellation period does not limit any mandatory statutory right of withdrawal or cancellation that may apply before or after delivery.
15. Returns, Refunds, and Exchanges
Returns, refunds, damaged product claims, replacements, and exchanges are governed by our Return and Refund Policy.
Eligible standard products may be returned by notifying Averyton within 14 calendar days after delivery.
Products that are genuinely personalized or produced according to individual customer specifications may be excluded from change of mind returns where permitted by applicable law.
Custom products remain eligible for remedies if they are damaged, defective, incorrect, or materially different from the agreed specifications.
The Return and Refund Policy forms part of these Terms of Service.

If there is a conflict between these general Terms and an order specific Distance Sales Agreement, the order specific Distance Sales Agreement will control for that transaction, subject always to mandatory consumer law.
17. Customer Accounts
You may be able to create a customer account to view orders, manage information, or access other features.
You are responsible for:
Providing accurate account information
Maintaining the confidentiality of account credentials
Restricting unauthorized access to your account
Informing us promptly of suspected unauthorized activity
We may suspend access to an account when reasonably necessary to protect the customer, Averyton, payment providers, or other users.
We will not be responsible for unauthorized account activity caused by a customer’s failure to protect login credentials, except where the loss results from our own breach of legal duty.
18. Reviews and Customer Content
You may be able to submit product reviews, photographs, comments, suggestions, or other content.
You retain ownership of content you create. By voluntarily submitting content for publication, you grant Averyton a nonexclusive, worldwide, royalty free license to host, reproduce, display, format, and use that content for operating and promoting Averyton, subject to applicable privacy and consumer law.
You confirm that:
You created the content or have permission to submit it
The content is accurate to the best of your knowledge
The content does not infringe another person’s rights
The content is not unlawful, threatening, discriminatory, fraudulent, or misleading
The content does not contain malware or harmful code
We may moderate or remove content that violates these Terms or applicable law. We will not remove a genuine negative review solely because it is unfavorable.
19. Intellectual Property
The Averyton name, logo, visual identity, website design, product photography, mockups, written descriptions, graphics, databases, software elements, and other original website content are owned by or licensed to Averyton and may be protected by intellectual property laws.
You may access the website for personal and lawful shopping purposes.
You may not, without prior written permission:
Copy or reproduce Averyton product photography
Download or extract print ready artwork files
Use Averyton branding in a misleading manner
Republish substantial portions of the website
Use automated tools to scrape product data or images
Create counterfeit Averyton products
Represent yourself as affiliated with Averyton
This section does not claim exclusive ownership of underlying historical artworks that are in the public domain and does not restrict any lawful use of public domain material obtained independently from Averyton.
20. Prohibited Uses
You may not use the website or services:
For an unlawful, fraudulent, or deceptive purpose
To violate intellectual property, privacy, publicity, or other legal rights
To submit false payment or identity information
To interfere with website security or operation
To transmit malware, viruses, or harmful code
To attempt unauthorized access to accounts or systems
To scrape, crawl, harvest, or extract data without permission
To conduct unauthorized resale, payment processing, or fraudulent transactions
To harass, threaten, discriminate against, or harm another person
To circumvent geographic, payment, security, or purchase restrictions
We may restrict access or cancel affected orders when reasonably necessary to respond to prohibited activity.
21. Third Party Services and Links
The website may contain links to or integrations with third party services, including payment providers, shipping providers, social media platforms, analytics providers, and other websites.
Third party services may operate under their own terms and privacy policies.
We are not responsible for the independent content or conduct of third party websites that we do not control.
However, the use of a third party production, payment, or delivery provider does not exclude Averyton’s responsibilities as the seller where those responsibilities cannot lawfully be excluded.
22. Privacy
Personal information is processed in accordance with our Privacy Policy.
By using our services, you acknowledge that personal information may be processed by Averyton and relevant service providers, including Shopify, iyzico, production providers, shipping carriers, and fraud prevention providers, as described in that policy.
23. Service Availability
We may update, suspend, or modify website features for maintenance, security, legal compliance, technical improvements, or operational reasons.
We do not guarantee that the website will always be available without interruption.
We will not intentionally interfere with an accepted order merely because a website feature becomes unavailable.
Temporary website interruption does not affect an existing customer’s contractual or statutory rights.
24. Disclaimer of Warranties
We will provide products and services with reasonable care and skill and in accordance with applicable consumer law.
Except for warranties, guarantees, and rights that cannot legally be excluded, the website and its general informational content are provided on an “as available” basis.
We do not guarantee that:
The website will always be uninterrupted or error free
Every historical or editorial statement will be free from minor nonmaterial error
Website colours will appear identically on every device
Third party services will always remain available
Nothing in this section excludes responsibility for products that are defective, unsafe, not as described, or otherwise nonconforming under applicable law.
25. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes or limits liability for:
Death or personal injury caused by negligence where such liability cannot be excluded
Fraud or fraudulent misrepresentation
Deliberate misconduct or gross negligence where applicable
Violation of mandatory consumer rights
Defective, unsafe, or materially misdescribed goods
Failure to provide a remedy required by law
To the maximum extent permitted by law, Averyton will not be responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.
Averyton is not responsible for business losses arising from a consumer purchase, including lost profits, lost revenue, lost business opportunity, or interruption of business operations.
This section does not affect remedies available under applicable consumer protection law.
26. Indemnification
To the extent permitted by law, you agree to be responsible for losses reasonably incurred by Averyton as a direct result of your:
Fraudulent or unlawful conduct
Intentional violation of these Terms
Infringement of another person’s intellectual property or privacy rights
Submission of content you had no right to provide
Unauthorized interference with the website or payment systems
This section does not require a consumer to compensate Averyton for losses caused by Averyton, its service providers, or circumstances outside the consumer’s reasonable control.
27. Events Beyond Reasonable Control
Averyton will not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government action, epidemics, carrier disruption, customs disruption, infrastructure failure, cyber incidents, labor disputes, or material shortages.
We will take reasonable steps to reduce the effect of such an event and will notify affected customers when appropriate.
This section does not remove any cancellation, refund, or other remedy required by applicable law.
28. Suspension and Termination
You may stop using the website at any time.
We may suspend or terminate website access when reasonably necessary because of:
A material violation of these Terms
Fraudulent or unlawful activity
Security risks
Abuse of another person or our service providers
Legal or regulatory requirements
Termination of website access does not automatically cancel an accepted order and does not remove rights or obligations that arose before termination.
Provisions that by their nature should continue after termination will remain effective, including payment obligations, intellectual property provisions, liability provisions, and dispute provisions.
29. Governing Law and Consumer Rights
These Terms and the operation of Averyton are generally governed by the laws of the Republic of Turkiye.
However, if you are a consumer in the United States, European Union, European Economic Area, United Kingdom, Switzerland, or another jurisdiction that provides mandatory consumer protection, this choice of law does not deprive you of the protection of mandatory laws applicable in your country of residence.
Consumers may bring claims before any court or consumer authority that has jurisdiction under applicable law.
For disputes that do not involve a consumer and where another jurisdiction is not required by law, the courts and enforcement offices of Izmir, Turkiye will have jurisdiction.
Before commencing formal proceedings, customers are encouraged to contact support@averyton.com so that we can attempt to resolve the matter fairly and promptly.
30. Changes to These Terms
We may update these Terms to reflect changes in our services, products, technology, service providers, business practices, or legal obligations.
The updated Terms will be published on this page with a revised “Last Updated” date.
Changes will not retroactively reduce rights relating to an order already accepted unless required by law or expressly agreed with the customer.
31. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or removed where necessary.
The remaining provisions will continue in effect.
32. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.
A waiver will be effective only when clearly confirmed in writing.
33. Entire Agreement
These Terms, together with the policies and order specific documents referenced in them, form the agreement between Averyton and the customer regarding use of the website and purchase of products.
They replace prior general discussions or communications relating to the same subject, but do not replace an order specific promise expressly confirmed by Averyton.
