Distance Sales Agreement

This Distance Sales Agreement governs purchases made through the Averyton online store at www.averyton.com.

The order summary, checkout information, product page, shipping information, Pre Contract Information provided before payment, and order confirmation sent to the Buyer form an integral part of this Agreement.

1. Parties

The Seller is referred to in this Agreement as “Averyton,” “Seller,” “we,” “us,” or “our.”

1.2 Buyer

The Buyer is the individual or legal entity whose name, contact information, billing address, and delivery address are entered during checkout.

The Buyer is referred to in this Agreement as the “Buyer,” “Customer,” or “you.”

Where the Buyer purchases primarily for personal purposes outside their trade, business, craft, or profession, the Buyer may also qualify as a “Consumer” under applicable law.

2. Purpose and Scope

This Agreement sets out the rights and obligations of the Seller and the Buyer regarding products ordered through www.averyton.com using a distance communication method.

Averyton offers fine art prints, framed artwork, posters, canvas products, and selected home decor products.

Averyton currently accepts orders for delivery to the United States, the United Kingdom, and supported European destinations displayed at checkout.

Orders for delivery to Turkiye are not currently accepted.

3. Order Specific Information

The following information is determined separately for every order and appears on the checkout page and in the order confirmation:

  1. Order number and order date

  2. Buyer’s name and contact information

  3. Billing and delivery addresses

  4. Product title and description

  5. Selected artwork, format, material, paper, frame, color, and size

  6. Quantity

  7. Unit price and total product price

  8. Applicable taxes

  9. Shipping method and shipping charge

  10. Any discount or promotion

  11. Total amount payable

  12. Payment method

  13. Estimated processing and delivery time

The checkout summary and electronic order confirmation constitute the order specific schedule to this Agreement.

The Buyer is responsible for reviewing this information and correcting any errors before submitting the order.

4. Pre Contract Information

Before placing an order, the Buyer is provided with clear information concerning:

  1. The principal characteristics of the products

  2. The identity and contact details of the Seller

  3. The total price and applicable charges

  4. Payment methods

  5. Processing and estimated delivery times

  6. Shipping options

  7. The right of withdrawal and its conditions

  8. Return costs and procedures

  9. Circumstances in which the right of withdrawal may not apply

  10. Legal remedies for damaged, defective, incorrect, or nonconforming goods

By placing an order, the Buyer confirms that they have reviewed the product information, order summary, applicable store policies, and this Agreement before payment.

This confirmation does not waive or restrict any mandatory consumer right.

5. Formation of the Contract

Products displayed on the Website constitute an invitation to place an order.

The Buyer submits an offer to purchase by completing checkout and selecting the button confirming that the order involves an obligation to pay.

After the order is submitted, Averyton sends an electronic acknowledgement or order confirmation to the email address provided by the Buyer.

The sales contract is formed when Averyton expressly accepts the order or begins fulfilling or dispatching the order, whichever occurs first.

An automatically generated acknowledgement of receipt does not prevent Averyton from rejecting an order for a legitimate reason, including:

  1. Product or material unavailability

  2. Payment authorization failure

  3. An evident pricing or technical error

  4. Suspected fraud or unauthorized payment

  5. An incomplete or invalid delivery address

  6. A delivery destination not supported by the Website

  7. Legal or regulatory restrictions

If an order is rejected after payment has been authorized or collected, the amount charged for the rejected order will be refunded promptly using the original payment method.

6. Product Characteristics

The principal characteristics of each product are stated on the relevant product page.

The Buyer is responsible for selecting the correct artwork, format, paper, material, frame, color, orientation, and dimensions before completing the order.

Measurements are stated as accurately as reasonably possible. Minor production tolerances may occur depending on the selected material and manufacturing process.

Product images are prepared to represent each artwork and product as accurately as possible. However, color, contrast, texture, brightness, and fine details may appear slightly different due to:

  1. Screen and monitor calibration

  2. Device settings

  3. Lighting conditions

  4. Natural variations in paper, canvas, and framing materials

  5. Printing and production tolerances

  6. Differences between a digital image and a physical printed surface

These minor differences do not constitute a defect unless the product materially differs from its description or fails to meet mandatory conformity requirements.

7. Digital Restoration and Historical Artwork

Averyton’s historical art reproductions begin with genuine historical artworks and source materials.

Digital restoration may include careful correction of age related damage, dust, scratches, stains, fading, scanning imperfections, tonal imbalance, and visual distortion.

Averyton does not use generative artificial intelligence to create or recreate historical artworks offered as authentic historical reproductions.

Digital restoration is performed for the purpose of producing a faithful fine art reproduction. It does not constitute physical conservation of the original painting or historical object.

Many historical artworks reproduced by Averyton are in the public domain. Averyton does not claim exclusive copyright ownership over an underlying original work that is legally in the public domain.

8. Prices and Currency

The price applicable to an order is the price displayed at checkout when the Buyer submits the order.

Prices may be displayed in different currencies depending on the Buyer’s location or selected market.

Before payment, the checkout page displays the product price, applicable discounts, shipping charges, taxes collected by Averyton, and the total amount payable.

Averyton may change prices at any time. A price change does not affect an order already accepted, except where the displayed price resulted from an obvious and genuine technical error.

The Buyer’s bank, card issuer, or payment provider may apply currency conversion rates or international transaction fees. Charges imposed independently by those institutions are not controlled by Averyton.

9. Taxes, Customs Duties, and Import Charges

Averyton collects taxes when required and supported by the applicable checkout system.

For international orders, import VAT, customs duties, brokerage charges, or other government imposed charges may apply depending on:

  1. The destination country

  2. The country from which the order is fulfilled

  3. The value and classification of the goods

  4. Applicable customs and tax laws

Where such charges are not collected during checkout, they may be payable by the Buyer upon import or delivery, provided that this is permitted under applicable law.

Free shipping refers to the standard carrier transportation charge. It does not automatically include customs duties, import VAT, brokerage fees, or other government imposed charges unless checkout expressly states that such charges are included.

Averyton will provide reasonably available information concerning these charges before purchase, but final assessments may be made by the destination country’s customs or tax authority.

10. Payment

The Buyer must pay the total amount displayed at checkout using one of the payment methods offered on the Website.

Payment services may be provided by iyzico, operated by iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş., Shopify Payments where available, card networks, banks, or other payment providers displayed during checkout.

Payment providers may process payment and transaction information under their own terms and privacy policies.

The use of a payment provider does not change the identity of the Seller. The sales contract remains between the Buyer and Averyton.

Averyton does not directly store complete payment card details when payment information is securely processed by an authorized payment provider.

11. Production and Processing

Most Averyton products are prepared or produced after an order is placed.

Orders are normally processed within 1 to 3 business days, excluding weekends and public holidays.

Processing time is separate from delivery time.

An order containing multiple products may be produced or delivered in more than one shipment. Where possible, relevant tracking information will be provided for each shipment.

12. Shipping Charges

Standard Shipping

Standard shipping is provided free of charge to supported destinations unless a different charge is clearly displayed at checkout.

Express Shipping

Customers who request faster delivery may select an available express shipping service for an additional charge.

The express shipping charge is displayed before payment and depends on the destination, product dimensions, weight, and carrier.

Choosing express shipping generally reduces carrier transit time. It does not necessarily reduce the time required to prepare or produce an item.

13. Estimated Delivery Times

Estimated delivery times after processing are:

United States: 7 to 14 business days
United Kingdom: 7 to 14 business days
Europe: 5 to 10 business days

These periods are estimates and are not guaranteed delivery dates unless Averyton expressly agrees to a specific date in writing.

Delivery may be affected by customs procedures, carrier disruptions, severe weather, public holidays, security inspections, strikes, incorrect address information, or events outside Averyton’s reasonable control.

If Averyton cannot dispatch an order within the promised period, the Buyer will be notified and may be offered a revised date. Where required by applicable law, the Buyer may accept the delay or cancel the affected order for a full refund.

Unless another period has been expressly agreed, products will be delivered no later than the maximum period required by applicable consumer law.

14. Delivery and Transfer of Risk

Delivery is completed when the Buyer, or a third person designated by the Buyer other than the carrier, obtains physical possession of the product.

For Consumer orders, the risk of accidental loss or damage generally remains with Averyton until physical delivery, except where the Buyer independently appoints a carrier not offered by Averyton.

The Buyer must provide a complete and accurate delivery address.

If a delivery fails because the Buyer supplied an incorrect or incomplete address, refused delivery without a lawful reason, or did not collect the shipment after reasonable carrier notice, Averyton may charge reasonable and documented redelivery costs where permitted by law.

This provision does not apply where the delivery failure was caused by Averyton or its carrier.

15. Order Cancellation Before Dispatch

The Buyer should contact support@averyton.com immediately if they wish to cancel or change an order.

Because many products enter production shortly after an order is placed, Averyton cannot guarantee that a requested change or cancellation can be completed before production or dispatch.

Nothing in this section restricts a Consumer’s statutory right of withdrawal where that right applies.

Custom made or clearly personalized products may become noncancellable once production has started, subject to applicable law.

16. Right of Withdrawal

Unless an exception applies, a Consumer may withdraw from an eligible distance sales contract within 14 calendar days without providing a reason and without paying a penalty.

For goods, the withdrawal period begins on the day after the Consumer, or a person designated by the Consumer other than the carrier, receives the product.

Where a single order is delivered in separate shipments, the period begins on the day after the final product or final part of the order is received.

The Consumer may exercise the right of withdrawal by sending a clear statement to:

The Consumer may use the Model Withdrawal Form at the end of this Agreement, but use of the form is not mandatory.

It is sufficient for the Consumer to send the withdrawal notice before the 14 day period expires.

If mandatory law provides the Consumer with a longer withdrawal period or additional rights, the longer or more protective rule will apply.

17. Return Procedure Following Withdrawal

After notifying Averyton of withdrawal, the Consumer must follow the return instructions supplied by customer support.

Products must not be returned to the registered office unless Averyton expressly confirms that address in writing as the correct return destination.

Unless a longer period is required by applicable law, the Consumer must send the product back within 14 calendar days after notifying Averyton of the withdrawal.

The Consumer should:

  1. Package the product securely

  2. Include the order number

  3. Use the return address provided by Averyton

  4. Use a trackable shipping method

  5. Retain proof of shipment until the return is completed

The Consumer may inspect the product to the extent reasonably necessary to determine its nature, characteristics, and quality.

The Consumer may be responsible for a reduction in value caused by handling beyond what is reasonably necessary to inspect the product.

Original packaging is recommended for safe transportation but will not be treated as an absolute condition of withdrawal where applicable law provides otherwise.

18. Return Shipping Costs

For a change of mind withdrawal concerning a conforming product, the Consumer is responsible for the direct cost of return shipping unless:

  1. Averyton agrees to pay the cost

  2. Averyton failed to inform the Consumer of that responsibility before purchase

  3. The product is defective, damaged, incorrect, or materially different from its description

  4. Applicable mandatory law requires Averyton to bear the cost

Averyton pays or reimburses reasonable return shipping costs for verified defective, damaged, incorrect, or nonconforming products.

No restocking fee is charged for a valid statutory withdrawal.

19. Refunds Following Withdrawal

For an eligible withdrawal, Averyton will refund:

  1. The price paid for the returned product

  2. Any applicable tax collected on that product

  3. The cost of the least expensive standard delivery option offered, if a delivery charge was paid and reimbursement is required by law

Additional charges paid for express, priority, or upgraded delivery are not refundable beyond the cost of standard delivery unless the express service itself was not provided as agreed.

Refunds will be issued using the same payment method used for the original transaction unless the Buyer expressly agrees otherwise.

Averyton will process the refund within 14 days after receiving the withdrawal notice. Where permitted by law, Averyton may withhold the refund until:

  1. The returned product is received, or

  2. The Consumer supplies evidence that the product has been sent back

Whichever occurs first will apply.

Actual posting times after a refund is issued may depend on the Buyer’s bank, card issuer, or payment provider.

20. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply to goods that are:

  1. Made to the Consumer’s individual specifications

  2. Clearly personalized

  3. Produced in a bespoke size not offered as a standard catalog option

  4. Modified with personalized text, names, dates, or inscriptions

  5. Prepared using a customer supplied image or design

  6. Subject to a customer requested crop, color treatment, composition change, or other individual artistic alteration

  7. Produced with a uniquely commissioned frame or presentation specification

Selecting a standard artwork, size, paper, canvas, or frame option normally offered in Averyton’s catalog does not automatically make a product personalized where applicable law treats it as an ordinary catalog product.

The withdrawal exception for custom or personalized products does not limit the Buyer’s rights when an item is defective, damaged, incorrectly produced, or materially different from the agreed specifications.

21. Damaged, Defective, Incorrect, or Nonconforming Products

The Buyer should inspect the product as soon as reasonably possible after delivery.

For faster assistance with visible transit damage, Averyton asks the Buyer to contact support@averyton.com within 7 calendar days of delivery.

The Buyer should provide:

  1. The order number

  2. A description of the issue

  3. Clear photographs of the product

  4. Photographs of the exterior and interior packaging

  5. A photograph of the shipping label where available

The seven day notification request helps Averyton investigate carrier damage efficiently. It does not remove or shorten any mandatory statutory right or legal guarantee.

Where a product is verified as damaged, defective, incorrect, or materially different from its description, Averyton will provide an appropriate remedy in accordance with applicable law. Depending on the circumstances, this may include:

  1. Replacement

  2. Repair where appropriate

  3. Reproduction of the product

  4. Partial refund

  5. Full refund

Averyton will bear reasonable return or replacement delivery costs where the product is legally nonconforming.

Consumers in the European Union retain the minimum legal guarantee required under EU and applicable national law. Consumers in the United Kingdom, the United States, and other supported destinations retain all nonwaivable rights available under the laws applicable to them.

22. Lost or Undelivered Orders

If tracking indicates that an order may be lost or if the order is not delivered within the applicable delivery period, the Buyer should contact support@averyton.com.

Averyton may open an investigation with the carrier and request reasonable information needed to locate the shipment.

If the order is confirmed lost or Averyton cannot complete delivery within the legally required period, Averyton will offer an appropriate remedy, which may include reshipment or a refund.

Where applicable law gives the Buyer a choice between accepting a delay and cancelling the order, that choice will be respected.

A refund for an undelivered order will be issued to the original payment method and will not be limited to store credit.

23. Intellectual Property

Purchasing an Averyton product transfers ownership of the physical product only.

The purchase does not transfer copyright, trademark rights, reproduction rights, commercial licensing rights, or digital distribution rights in Averyton’s original restoration work, product photography, written content, branding, or website materials.

Averyton does not claim exclusive copyright in the underlying original image of an artwork that is legally in the public domain.

Unless applicable law expressly permits otherwise, the Buyer may not commercially reproduce, scan, distribute, sublicense, or sell Averyton’s original digital restoration files, product images, written descriptions, or branded materials.

24. Personal Data

Personal data submitted during checkout is processed for purposes including:

  1. Order administration

  2. Payment processing

  3. Fraud prevention

  4. Production and fulfillment

  5. Shipping and delivery

  6. Customer service

  7. Returns and refunds

  8. Legal, accounting, and tax compliance

25. Force Majeure and Events Beyond Reasonable Control

Averyton is not responsible for a delay or failure caused by an event that could not reasonably have been prevented or controlled, including natural disasters, war, civil disorder, government restrictions, carrier shutdowns, widespread transportation interruption, customs closure, epidemic, fire, flood, earthquake, or major infrastructure failure.

Averyton will notify affected Buyers when reasonably possible and take proportionate steps to minimize disruption.

This section does not remove the Buyer’s right to cancel an order or receive a refund where such a right is provided by mandatory law.

26. Complaints and Customer Support

Questions, complaints, cancellation notices, and requests concerning an order may be submitted to:

Averyton will make reasonable efforts to review and respond to complaints promptly.

Consumers retain the right to contact a competent consumer protection authority, alternative dispute resolution body, or court where available under applicable law.

Averyton does not currently commit to voluntary participation before a specific consumer arbitration body unless participation is required by applicable law.

27. Governing Law and Mandatory Consumer Protection

This Agreement is generally governed by the laws of Turkiye because the Seller is established in Turkiye.

However, this choice of law does not deprive a Consumer of mandatory protections available under the law of the country in which the Consumer habitually resides where those protections legally apply to the transaction.

Nothing in this Agreement:

  1. Excludes liability that cannot legally be excluded

  2. Limits a mandatory legal guarantee

  3. Removes a Consumer’s right to seek a statutory remedy

  4. Requires a Consumer to waive access to a court that has mandatory jurisdiction

  5. Overrides mandatory European Union, national European, United Kingdom, United States federal, state, or other applicable consumer protection law

28. Electronic Communications and Contract Records

The Buyer agrees that order information, invoices, confirmations, notices, and contractual documents may be supplied electronically to the email address entered during checkout.

Averyton may retain records of the order and Agreement as required for contractual, accounting, tax, fraud prevention, and legal compliance purposes.

The Buyer is advised to save or print:

  1. This Agreement

  2. The order confirmation

  3. The invoice or payment receipt

  4. The applicable product description

  5. The Return and Refund Policy

  6. The Shipping Policy

The version of this Agreement in effect when the order is placed applies to that order.

29. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or replaced in a manner that most closely reflects its lawful purpose without reducing mandatory consumer protections.

30. Entire Agreement

This Agreement, together with the order specific checkout information, product description, Pre Contract Information, order confirmation, Privacy Policy, Return and Refund Policy, and Shipping Policy, constitutes the agreement between the Seller and the Buyer concerning the relevant order.

In the event of a conflict, mandatory consumer protection law will prevail.

31. Acceptance

By submitting an order with an obligation to pay, the Buyer confirms that:

  1. The order information has been reviewed

  2. The selected products and options are correct

  3. The total amount payable has been displayed

  4. The applicable shipping and delivery information has been provided

  5. The Buyer has had an opportunity to read this Agreement and related store policies

  6. The Buyer understands that placing the order creates an obligation to pay

This acceptance does not waive any mandatory consumer right.
